Ellis County DA Steps Away From Prosecuting Matthew Zajic

The Ellis County and District Attorney’s Office will no longer handle criminal cases involving Precinct 2 Commissioner Matthew Zajic after District Attorney Lindy Beaty recused her office from the matter.
The decision came after the Ennis Police Department formally submitted the cases to prosecutors, according to a statement released by Beaty’s office. Beaty said the recusal was necessary because of her office’s close working relationship with the Ellis County Commissioners Court and concerns about how continued involvement could be viewed by the public. “A recusal in this matter is necessary and will avoid the possible appearance of impropriety,” Beaty said, adding that an independent prosecutor would help protect public confidence in the process. On Aug. 20, 504th District Judge Greg Wilhelm signed an order appointing Rockwall County Criminal District Attorney Kenda Culpepper as Ellis County and District Attorney Pro Tem. Wilhelm currently presides over Ellis County’s 504th District Court. Culpepper’s office will now independently decide whether charges should be filed and, if so, how the cases will be prosecuted. Culpepper has served as Rockwall County’s Criminal District Attorney since 2009. The proceedings will remain in Ellis County. Zajic was arrested by Ennis police in June following an alleged theft incident at a local retailer. Zajic remains Precinct 2 commissioner while the legal process continues. He is presumed innocent unless proven guilty in court.
