Officer Asked Detainee for Sex. Ellis County Jury Sent Him to Jail.

A former Cedar Hill police officer Donald Najee Mercer has been sentenced to 300 days in the Ellis County Jail after a jury convicted him of official oppression.
According to prosecutors, the case stemmed from an August 7, 2024, traffic stop in Cedar Hill. Mercer was on duty, in uniform and driving a marked police vehicle when he pulled over a woman, conducted field sobriety tests, arrested her for DWI and took her to Methodist Midlothian Medical Center for a blood draw. Prosecutors said that after the blood draw, the woman told Mercer she had marijuana in her left pocket. Mercer and the woman kissed, and Mercer removed the marijuana from her pocket, according to evidence presented at trial. The District Attorney’s Office said Mercer never booked the marijuana into evidence or included it in his police report. He later told the woman it had been “disposed of.” Prosecutors said Mercer then drove the woman to the Navarro College parking lot in Midlothian, turned off the vehicle lights and his body camera, and asked her to perform oral sex. She refused. During the punishment phase, prosecutors said testimony showed this was not Mercer’s first incident involving sexual harassment of a detainee. At least two other incidents were discovered, including testimony from one woman who said Mercer groped her breasts during a traffic stop. Prosecutors said Mercer turned off his body camera to hide evidence of his conduct. Although Mercer was eligible for probation, the jury denied probation and sentenced him to serve 300 days in the Ellis County Jail.
